Asylum claims are considered under the 1951 UN Refugee Convention, and its incorporation European asylum law into European Asylum law.


To be granted asylum (to get refugee status), it’s necessary to show that you have have a well founded fear of persecution if returned to your home country. 

Fear of persecution must be based on:

  • Race

  • Religion

  • Nationality/Ethnicity

  • Particular Social Group (includes political affiliations and other social groups that have been targeted.
